1. Acceptance and scope

These Terms of Use (“Terms”) apply to your access to and use of the TJ Funding website, including any content, forms, tools, or communications made available through it (collectively, the “Site”). By accessing or using the Site, you agree to these Terms and our Privacy Policy.

If you use the Site on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

2. Commercial use only

TJ Funding Group LLC provides commercial lending backed by sponsors to lower and middle market businesses. The Site is for business-purpose financing, not personal, family, or household credit. You must be at least 18 years old and legally able to enter into binding agreements to use the Site.

3. Credit review and financing agreements

Submitting a capital request does not require you to accept financing.

We require a corporate guarantee only, not a personal guarantee. Your executed financing agreement with TJ Funding Group LLC governs the financing.

4. Information you provide

You agree that information submitted through the Site will be current, accurate, and complete to the best of your knowledge. You may submit information only when you have the right and authority to do so.

When you submit a capital request and accept the consent shown with the form, you authorize TJ Funding Group LLC to contact you and use the information for capital request review and facility matching. We do not distribute your request to other lenders. Submission alone does not initiate a credit check or inquiry. Additional authorization may be required for later verification or credit review. Our Privacy Policy explains how information is handled.

5. Electronic communications

When you contact us electronically, you consent to receive responsive communications by email, telephone, or other methods you provide. Standard carrier or data charges may apply. You may ask us to stop non-required marketing communications at any time, but we may still send administrative or transaction-related messages.

6. Acceptable use

You may use the Site only for lawful purposes. You may not:

• submit false, misleading, fraudulent, or unauthorized information;
• interfere with the Site, its security, or another person’s use of it;
• attempt to gain unauthorized access to accounts, systems, or data;
• use automated tools to scrape, copy, or overload the Site without written permission; or
• use Site content in a way that infringes intellectual property, privacy, or other rights.

7. Site content and ownership

The Site and its original content, design, graphics, logos, and other materials are owned by or licensed to TJ Funding Group LLC and are protected by applicable intellectual property laws. TJ Funding Group LLC grants you a limited, revocable, non-exclusive right to access and use the Site for its intended business purpose.

You may not reproduce, distribute, modify, publicly display, sell, or create derivative works from Site materials without prior written permission, except as allowed by law.

8. Third-party services and links

The Site may link to external websites with their own terms and privacy practices. Review those policies before providing information there. Our handling of information collected through this Site is described in our Privacy Policy.

9. Disclaimers

TJ Funding Group LLC works to keep Site information useful and current, but does not warrant that every item will always be complete, accurate, available, secure, or error-free. To the maximum extent permitted by law, the Site is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.

10. Limitation of liability

To the maximum extent permitted by law, TJ Funding Group LLC and its owners, personnel, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption arising from or related to use of, or inability to use, the Site.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Changes, governing law, and contact

We may update these Terms by posting a revised version on this page and changing the “Last updated” date. Continued use of the Site after an update means you accept the revised Terms.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute relating to the Site or these Terms will be brought in a court of competent jurisdiction located in New York County, New York, unless applicable law requires otherwise.
